These Terms of Service govern your access to lokeevan.com and purchases made through the website.

The website and the LOKEEVAN brand are operated by HONG KONG SMART EBIKE TECHNOLOGY LIMITED (“LOKEEVAN”, “we”, “us” or “our”).

By using the website or placing an order, you agree to these Terms. Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded under applicable consumer law.

1. Eligibility

You must have the legal capacity to enter into a binding contract in your country of residence.

If you place an order on behalf of a business or organisation, you confirm that you have authority to bind that business or organisation.

2. Product Information

We take reasonable care to ensure that product descriptions, photographs, specifications, prices and availability information are accurate.

Display settings, lighting and photography may cause colours to appear slightly different from the physical product. Product-specific functions, range, battery performance, sonar performance and operating conditions are governed by the specifications stated on the relevant product page.

Performance may be affected by weather, water conditions, interference, payload, battery condition, obstacles and local environmental factors.

If a material error is identified before dispatch, we will contact you and provide the option to confirm the corrected order or cancel it for a full refund.

3. Orders and Contract Formation

Submitting an order is an offer to purchase the selected products.

An automated order confirmation acknowledges receipt of the order but does not necessarily constitute acceptance. Unless mandatory law provides otherwise, the sales contract is formed when we send a dispatch confirmation.

We may decline or cancel an order before dispatch where:

• The product is unavailable;

• Payment cannot be authorised;

• The price or product information contains a material error;

• The order appears fraudulent or unlawful;

• Delivery is unavailable to the selected destination; or

• We are legally prohibited from supplying the product.

If payment has already been taken for an order we do not accept, we will issue a full refund.

4. Prices and Payment

The total price payable, including any charges collected by us, will be displayed before you place the order.

Payment must be made using a payment method offered at checkout. You confirm that you are authorised to use the selected payment method.

We do not charge a fixed refund or payment-processing fee when an EU consumer exercises the statutory right of withdrawal.

5. Cancellation, Returns and Refunds

You may cancel an order for a full refund before dispatch.

After dispatch, cancellations, withdrawals, returns, defective products and refunds are governed by our Return and Refund Policy and applicable law.

6. Shipping and Delivery

Processing times, delivery estimates, split shipments, loss and transport damage are governed by our Shipping Policy.

Risk of loss or damage remains with us until the goods are physically received by you or a third party designated by you, except where you independently commission a carrier not offered by us.

7. Product Use and Safety

You must read and follow all supplied instructions, safety notices, charging guidance and maintenance requirements.

Bait boats and related electronic equipment must be used responsibly and in accordance with local laws, fishing regulations, water-owner rules and environmental requirements.

You must not use a product:

• In unsafe weather or water conditions;

• In prohibited waters or restricted navigation areas;

• In a manner that endangers people, animals, property or the environment;

• With damaged batteries, chargers, cables or seals; or

• In conflict with the operating instructions.

GPS, sonar, fish-finding, mapping, auto-return and telemetry functions are assistance features. They must not be treated as life-safety systems or as a substitute for responsible observation and judgement.

8. Legal Guarantee and Commercial Warranties

Any manufacturer’s warranty or voluntary commercial warranty is additional to, and does not replace, mandatory consumer rights.

For EU consumers, goods are covered by a minimum two-year legal guarantee against lack of conformity from the date of receipt, subject to any more favourable national rules.

9. Website Availability

We may update, suspend or modify parts of the website for maintenance, security, legal compliance or operational reasons.

We do not guarantee that the website will always be available without interruption, but this does not affect contracts already concluded or mandatory consumer rights.

10. Intellectual Property

Unless otherwise stated, the website content—including product names, text, graphics, photographs, videos, logos, designs and software—is owned by or licensed to HONG KONG SMART EBIKE TECHNOLOGY LIMITED.

You may use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, commercially exploit or create derivative works from website content without prior written permission.

11. Prohibited Conduct

You must not:

• Use the website for unlawful or fraudulent activity;

• Interfere with the website’s security or operation;

• Introduce malicious code;

• Attempt unauthorised access to an account or system;

• Submit false payment, identity or delivery information; or

• Infringe the rights of another person.

12. Third-Party Services

The website may use or link to third-party services, including payment providers, carriers, video platforms and social networks.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party content or services outside our reasonable control, except where applicable law provides otherwise.

13. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, death or personal injury caused by negligence, or liability arising under mandatory product-safety and consumer-protection laws.

To the maximum extent permitted by law, we are not liable for losses caused by:

• Misuse contrary to the instructions;

• Unauthorised modification or repair;

• Use in prohibited or unsafe conditions;

• Normal wear and tear;

• External radio interference or environmental conditions; or

• Events outside our reasonable control.

Any limitation in these Terms applies only to the extent permitted by the mandatory law applicable to you.

14. Personal Data

Personal data is handled in accordance with our Privacy Policy and applicable data-protection law.

15. Governing Law and Consumer Jurisdiction

These Terms are governed by the laws of Hong Kong, without depriving consumers of mandatory protections available under the laws of their country of habitual residence.

Nothing in these Terms prevents an EU consumer from bringing a claim before a court that has jurisdiction under applicable consumer law, including the courts of the consumer’s country of residence where the law permits.

16. Changes to These Terms

We may update these Terms from time to time. The version applicable to an order is the version available when that order is placed, unless a change is required by mandatory law.
